On February 4 2008, by Ordinance, DNA prosecutor Maria Trandabat comes to
the conclusion that the acts committed by the group's members are more serious
and requires a change of legal framing into aggravating. The Ordinance notes:

"Hereby I find: According to the resolution of February 21 2007, at 9.30 am, it
was decided to start the criminal prosecution against ..... (the nomination of the
suspects) and it was noted that, by abusively exercising their duties, during 2000-
2003, they produced a material damage of more than $ 400 million for BIR."
We underline the particularly important fact that the DNA Directive of February
4 2008 is still in force at present, because it was not denied by Daniel Morar, the

chief prosecutor of the DNA, and respectively, it has not been denied in
accordance with the provisions of art. 304 of C.P.P., which states:
"When the prosecutor finds that an act or a procedural measure of the criminal
investigation body is not given in compliance with the legal provisions or is
unfounded, he or she shall refuse to motivate it, ex officio, or based on the
complaint of the person concerned".
According to this legal provision, the Ordinance recognizing the International
Bank of Religions loss of over USD 400 million, produced by the interest group
organized by the two lawyers, is well founded.
On February 8 2008, Fănel Păvălache, summoned by the DNA, confirms in a

statement that the data and facts he described on 30 pages, called by the
prosecutor of the case "notes given in the preventive arrest" – being in fact, a
denunciation – were obtained from his associate, Arin Stănescu and his close
relatives. "
On February 29 2008, Mr. Cătălin Predoiu, the son in law of the accused Calin

Zamfirescu and the god-son of the other accused Ain Stănescu, is appointed
Minister of Justice.
On March 11 2008 Călin Zamfirescu, the father-in-law of the new minister,

Cătălin Predoiu, declared in the daily "Jurnalul Naţional" that "DNA will soon
remove from criminal prosecution all the 14 accused criminals."
On April 24 2008, the same prosecutor Maria Trandabat pronounces the
th
removing from the criminal prosecution Ordinance for all the accused. In our
country "prosecutors operate under the authority of the minister of justice."
On June 15 2010, Ion Popescu, the president of the BIR, who was willingly
th
assigned the status of a bank official, who insists in all courts to apply the law, is
convicted of "abuse of office".
