relied on the BIR case, so the Commissioner for Enlargement, Mr Olli Rehn,
               looked particularly into the evolution of its solution.
                       Having noted that in Romania, the competent authorities do not dare, do
               not have the  courage, or they are forbidden to take legal  action in this case,
               recently, representatives of the BIR shareholders have addressed the GRECO
               Secretariat (Group of States  Against Corruption) of the  Council of Europe,
               requesting that the fraudulent BIR bankruptcy, a case of organized crime and
               high-level institutionalized corruption, which has been notified to the competent
               Romanian authorities even by the Romanian Parliament itself, has been shifted
               to investigation from the National Anticorruption Department of Romania to a
               similar body in another European country.
                       Under the circumstances, the provisions of art. 52 par. 1 of the Romanian
               Constitution, stipulate that:
                        "A person who’s rights or legitimate interest were damaged by a public
               authority, by an administrative act or by not solving a claim within a legal term,
               is entitled to obtain the recognition of his rights..."
                       par. 3 of the same article states that:
                       "The  state is patrimonial accountable for  damages caused  by judicial
               errors."

               The DNA Directive of February 4  2008 states: the damage caused to the
               BIR amounts to over USD 400 million


               The File no. 194/P/2003 is still at the National Anticorruption Department, a
               criminal  case against the entire stakeholder group involved in fraudulent
               bankruptcy of the International Bank of Religions covered up “by accident”, after
               the appointment of Mr. Cătălin Predoiu as Minister of Justice, when his family
               law and liquidation firms being directly involved in the BIR case.

               The calendar of some "simple coincidences" in File no. 194/P/2003 regarding
               the fraudulent bankruptcy of BIR, in the DNA instrumentation:


               On September 26  2006, the ICCJ - Criminal Section, admits the appeal of the

               BIR Board of Directors (signed by the BIR President) and, by the final decision
               no. 5515, approves the prosecution in  personam  of the interest group (BIR
               liquidators) - Călin Zamfirescu, Arin Stănescu etc.

               On February 21  2007, based on the decision no. 5515 of 26.09.2006 of the HCCJ
               - Criminal Section, by DNA Resolution, it is initiated the criminal prosecution of
               the nominated accused persons, for the acts provided by art. 11 Law no. 78/2000
               and art. 246 Criminal Code.
