As shown, the General Prosecutor's Office attached to the High Court of
Cassation and Justice and the General Inspectorate of the Police were notified, as

of February 13 2002, by providing all the information, documents and evidences
obtained by the Parliamentary Commissions in this case.

7. It is clear from these evidence that the bankruptcy of BIR was premeditated
and organized by the owners of the liquidation company "Assets Reconversion
and Valuation", named Arin Stănescu, Călin Andrei Zamfirescu, in complicity
with persons from the BNR leadership, with some magistrates within the Section
VII Commercial of Bucharest Law Court (judges Maria Navala and Cristina
Negru). Different facts: On the night of the Fănel Păvălache flagrant (October

17 -18 2002), Maria Năvală and Arin Stănescu were at a hotel in Malta, where
th
they had a phone call from Fănel Păvălache.

8. It is also notorious that, "through the care" of the vice-governors Emil Iota
Ghizari and Mihai Bogza, the aforementioned firm was assigned with the
liquidation of all the Romanian banks that were bankrupt.

9. From the information obtained in this file, (vol.2 of the documentary paper of
the Chamber of Deputies - "Total War against Corruption in Romania") it was
established that some magistrates of the Commercial Section of the Bucharest
Court were related to the owners of this firm (close relatives of the magistrates -
sons, spouses - being liquidators themselves). Moreover, the same document
shows that the managers of the liquidation company have reached the point where
they wrote the decisions themselves in the bankruptcy files of the companies they
liquidated, and the magistrates only sign these decisions.

10. During the investigations in the file of the former government adviser Fănel
Păvălache, it was found that the deliberations of the court decisions in the
bankruptcy files took place in the apartment on Tudor Arghezi Street no. 26, 3rd
floor ap. 32, or through restaurants ("Café Ole"), at the order and directions of
liquidator-lawyer Arin Stănescu, together with senior officials representing the
Ministry of Justice and / or the Government.

11. The close relationship between the persons involved in the management of
the BNR and the managers of the liquidation company "Assets Reconversion and
Valuation" also derives profoundly from their mutual support in courts (the legal
counselor of the BNR, Nicoleta Nicolau, acting jointly with the representatives
of the liquidators without making an opposition to their actions of devastating the
BIR patrimony and to combat the devaluation of its funds by acquiring the so-
called "honor", "performance bonuses" etc.),thus demonstrating and
proving their complicity.
